General Terms and Conditions (GTC)


1. Scope of Application

These General Terms and Conditions (GTC) apply to all orders placed by consumers (§ 13 German Civil Code – BGB) via our online shop at https://homaera.de.
We do not recognize any differing terms and conditions of the customer unless we have expressly agreed to their validity in writing.

3. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.
By clicking the “Buy Now” button, you submit a binding order for the goods contained in your shopping cart.
The confirmation of receipt and acceptance of your order is sent via an automated email (“Order Confirmation”).
Upon this confirmation, the purchase contract becomes legally effective.


4. Prices and Payment Terms

All prices include statutory VAT and are subject to applicable shipping costs.
The prices valid at the time of the order shall apply.

Payment methods: Credit Card, PayPal, Klarna, Apple Pay, Google Pay, and Instant Bank Transfer.
The charge is made upon completion of the order.


5. Delivery and Shipping

Delivery is available exclusively within the EU.
Delivery time: 2–5 business days.
Shipping costs are displayed during the order process.


6. Retention of Title

The goods remain our property until full payment has been received.


7. Right of Withdrawal

Consumers are entitled to a statutory right of withdrawal.

8. Warranty

The statutory provisions regarding liability for defects apply.


9. Liability

We are fully liable for damages arising from injury to life, body, or health.
For other damages, we are liable only in cases of intent or gross negligence.
In cases of slight negligence, we are liable only for typical and foreseeable damages.


10. Customer Account & Order Data

You are required to provide truthful information when placing an order.
Login credentials must be kept confidential.
Contract texts are not stored permanently but can be accessed through the order confirmation.


11. Dispute Resolution and Online Dispute Resolution

The European Commission provides a platform for online dispute resolution:

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.


12. Applicable Law and Jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Jurisdiction is the registered office of NGR Dynamic Solution GmbH, provided the customer is a merchant.


13. Severability Clause

If individual provisions of these GTC are or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
